California's 2021 Housing Laws: What You Need to Know

Holland & Knight's land use attorneys will provide insights and an overview of legislation in their
annual housing legislative recap. Although 2020 was a largely dismal session regarding housing production legislation, new tenant protection laws could affect housing owners, managers and lenders. Our presenters will discuss notable new laws that affect housing project applicants and provide entitlement extensions as well as Senate Bill (SB) 35, State Density Bonus Law, Accessory Dwelling Units (ADU), Housing Element and California Environmental Quality Act (CEQA) amendments. Housing 2021: Regional Housing Production Mandates, Constraints and Vehicle Miles Traveled

Since 1980, California state law has required cities and counties to update general plan housing elements and zoning codes to accommodate projected future housing and population growth for the next eight years. Given the severity of the state's housing supply shortfall (estimated at 3.5 million units), the new Sixth Cycle Regional Housing Needs Assessment (RHNA) process is underway. It started with Southern California in 2019 and will be followed by the Bay Area. The process creates major opportunities to upzone properties (especially retail and commercial properties in counties that touch the ocean or San Francisco Bay) to accommodate more residential and mixed-use projects on a "wholesale" entitlement Housing Element update framework. This Sixth Cycle also coincides for the first time with SB 375, which requires regions to plan greenhouse gas reductions to achieve climate change goals while also accommodating projected housing, population and employment growth. Both the SB 375 process and the expansion of CEQA to regulate driving (even in an electric vehicle) as a vehicle mile traveled (VMT) impact to be avoided (or reduced and mitigated) put a premium value on infill and edge development. This webinar will provide practical suggestions for streamlining project approvals (including projects requiring general plan amendments and rezoning) under the twin mandates of RHNA and VMT.

Practical Guide to Union Labor Agreements, Construction Contractors and the Project Entitlement Process

Legislation to expedite housing and other types of projects increasingly includes requirements relating to payment of "prevailing wages" and use of "skilled and trained" construction workers. Unions also play an important role for entitlement approval and environmental review processes. This webinar will provide a practical overview of the differences between "prevailing wage" and "skilled and trained" worker requirements, the primary entitlement streamlining pathways that are dependent on having project labor agreements (PLAs) or similar deals in place, and further considerations in contractor and subcontractor selection and project pricing.
