Recent Developments in Law on Medical Assistance in Dying (MAID)

Our March Estate Law Lunch & Learn series session, will be hosted via Webinar.

On June 17, 2016, Canadian law established the right to have medically assisted dying included as a fundamental human right protected by our Charter of Rights and Freedoms by passing legislation and establishing a federal framework for Medical Assistance in Dying (MAID). This legislation made us part of a small group of jurisdictions globally which allow assisted dying.

For this session, we are pleased to welcome Elena Mamay, a Senior Associate and member of BLG's Commercial Litigation Group. Elena will guide us through some of the thorny issues that the judiciary has been grappling with since the implementation of MAID legislation.

It is timely to consider the topic of MAID given the recent developments in Canadian jurisprudence, including the landmark ruling from the Québec Superior Court of Justice in Truchon c. Procureur général du Canada, which may potentially set the groundwork for further legal challenges and change in legislation throughout the country.
