The Federal Government came to power in 2022 with an election mandate to boost wages, activating a key weapon in its arsenal: the ability to amend the Fair Work Act to correct the perceived power imbalance (in specific sectors) during enterprise bargaining.

In December 2022, the Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022 received royal assent. The amending Act made significant amendments:

  • to the types of enterprise agreements that could be made
  • to the powers of the Fair Work Commission to support parties or intervene in the bargaining process
  • to sunset pre-reform collective agreements (zombie agreements), which often contained less-favourable terms and conditions of employment
  • to remove some technical and administrative barriers that traditionally prevented enterprise agreements being approved by the Fair Work Commission.

Most of the enterprise agreement amendments only came into effect on 6 June 2023. How will these amendments impact your business?
