What are the validity requirements for an arbitration agreement in your jurisdiction?

Answer ... The arbitration agreement must be in written form (see question 1). It may be included as a clause in a contract or it may be a separate agreement. The agreement must be concluded with regard to a dispute that is arbitrable (see question 8).

Are there any provisions of legislation or any other legal sources in your jurisdiction concerning the separability of arbitration agreements?

Answer ... The International Commercial Arbitration Act provides that the arbitration agreement is separate from the other terms of the contract. The nullity of the contract does not lead to the invalidity of the arbitration clause.

Are there provisions on the seat and/or language of the arbitration if there is no agreement between the parties?

Answer ... The parties may choose the language and the seat of the arbitration proceedings. If there is no agreement regarding the language and the place where the proceedings will be held, the arbitration court may determine the place in accordance with the circumstances under the case and select the language for the proceedings.
