The Nunavut Court of Justice made an order vacating a custom adoption certificate issued pursuant to the Aboriginal Custom Adoption Act, S.N.W.T. 1994, c. 26. In this decision, the Court provides a thorough review of the ways of adopting a child in Nunavut. One way is in accordance with Inuit custom, and without involvement of the courts or any government agency. The other method is to proceed under the Adoption Act. The Court discussed various issues that have arisen in regards to custom adoptions, such as the consent of the biological parents, and the geographic range over which adoptions occur.
