Last week, the federal judiciary released its caseload statistics for the last reporting year. The statistics show that 7,008 FLSA cases were filed in the 12-month period ending March 31, 2011, compared to the 6,081 filed in the 12-month period ending March 31, 2010. So, FLSA filings increased by about 1,000.

Of course, we here in Florida have led the nation in FLSA filings for many years. As I tell clients, if you have yet to be sued by an employee for unpaid overtime, consider yourself lucky. Just about all employers, big and small, are vulnerable to these suits. I have seen nothing to suggest that the number of FLSA suits will decrease any time soon. I guess that is good news for employment attorneys, and bad news for most everybody else.
