Belgium: Nieuwe vergunningsprocedure in Brussel vanaf 1 september

Vorig jaar keurde het Brussels Hoofdstedelijk Gewest een grote hervorming van het Brussels Wetboek van Ruimtelijke Ordening (BWRO) goed. Een beperkt aantal hervormingen (meer in het bijzonder deze m.b.t. planning) trad reeds in werking op 30 april 2018 (zie ook onze eerdere newsflash van 2 mei 2018 hierover). Het tweede deel van de hervormingen zou normaal op 20 april 2019 in werking treden. Omdat een deel van de uitvoeringsbesluiten niet tijdig klaar waren, traden slechts enkele wijzigingen in werking op die datum en stelde de Brusselse Hoofdstedelijke Regering de inwerkingtreding uit tot 1 september 2019.

Vanaf 1 september 2019 zal u voor een ontwikkelingsproject in het Brussels Hoofdstedelijk Gewest rekening moeten houden met de volgende procedurele wijzigingen:

  • verschillende proceduretermijnen wijzigen:
    • afhankelijk van de adviezen c.q. onderzoeken die moeten worden aangevraagd c.q. gevoerd, bedraagt de beslissingstermijn 75, 90 of 160 dagen vanaf de datum van verzending van het ontvangstbewijs;
    • de beslissingstermijn is niet langer een termijn van orde, maar een vervaltermijn. Een overschrijding van de termijn resulteert evenwel niet onmiddellijk in een stilzwijgende weigering. In eerste instantie wordt de aanvraag automatisch aanhangig gemaakt bij de gemachtigde ambtenaar, die over een bijkomende termijn van 45 dagen beschikt om een beslissing te nemen. Wanneer ook deze termijn is overschreden, wordt de vergunning geacht stilzwijgend te worden geweigerd;
    • het volledigheids- en ontvankelijkheidsonderzoek duurt voortaan 45 dagen. Ontbrekende gegevens moeten worden aangeleverd binnen een vervaltermijn van 6 maanden;
  • de stedenbouwkundige vergunning zal van rechtswege vervallen indien zij niet is uitgevoerd binnen 3 (i.p.v. 2) jaar na de kennisgeving ervan. De werken mogen ook niet meer dan 1 jaar worden onderbroken. Een verzoek tot verlenging met één jaar is evenwel mogelijk in geval van overmacht of de noodzaak om één of meerdere overheidsopdrachten te sluiten;
  • de gemeente zal een vereenvoudigde en automatische regularisatievergunnning verlenen indien vergunningsplichtige werken vóór 1 januari 2000 werden uitgevoerd zonder vergunning, voor zover deze werken in overeenstemming zijn met de vroegere of huidige reglementering en op voorwaarde van een gunstig advies van de brandweer;
  • het toepassingsgebied van de verkavelingsvergunning wordt beperkt tot het bouwrijp maken van omvangrijke terreinen. Verkavelen zal enkel nog betrekking hebben op het verdelen van een terrein door een verkeersweg aan te leggen of te verlengen, die de verbinding maakt met een of meer onbebouwde kavels waarvan er minstens één is bestemd voor bewoning. Indien een richtplan van aanleg of een bijzonder bestemmingsplan in de operatie van de verdeling voorziet, geldt een vrijstelling voor het aanvragen van een verkavelingsvergunning;
  • voor gemengde projecten (i.e. projecten die zowel vallen onder de milieuvergunningsplicht als de stedenbouwkundige vergunningsplicht) worden de verschillende procedures beter op elkaar afgestemd. Beide aanvragen zullen voortaan gelijktijdig worden onderzocht, dit steeds door de gemachtigde ambtenaar (en niet het college van burgemeester en schepenen of de regering). Een volledige integratie van beide procedures zoals in Vlaanderen en Wallonië komt er (vooralsnog) niet;
  • de nieuwe handhavingsregels beschermen voortaan kopers te goeder trouw indien het gekochte onroerend goed is behept met een stedenbouwkundig misdrijf. Een koper die niet wist dat de vorige eigenaar een stedenbouwkundig misdrijf beging, is voortaan enkel strafrechtelijk aansprakelijk indien hij bewust de onregelmatige handelingen in stand houdt.

No delay in exercising or non-exercise by you and/or Mondaq of any of its rights under or in connection with these Terms shall operate as a waiver or release of each of your or Mondaq’s right.
