Spain: nuevas medidas para impulsar la tramitación de los instrumentos de planeamiento urbanístico en andalucía

La Consejería de Fomento, Infraestructuras y Ordenación del Territorio de la Junta de Andalucía (la "Consejería") aprobó a principios de marzo dos instrucciones con las que pretende agilizar y simplificar la tramitación de los instrumentos de planeamiento urbanístico en Andalucía.

Dado su contenido, dichas instrucciones resultan complementarias entre sí, en la medida que establecen determinadas pautas para la tramitación y aprobación definitiva de los instrumentos de planeamiento urbanísticos, que generalmente corresponde la Consejería, con el objetivo de aclarar cuestiones procedimentales e impulsar la actualización del planeamiento urbanístico municipal.

En este sentido, la aprobación y entrada en vigor de estas instrucciones trata de cumplir la voluntad del Consejo de Gobierno de la Junta de Andalucía, que instó a la Consejería a iniciar cuantas medidas fuesen necesarias para agilizar, simplificar, armonizar y aclarar los procedimientos y trámites administrativos en materia de urbanismo y ordenación del territorio.

1. La Instrucción 1/2019, de 8 de marzo, sobre determinadas actuaciones preparatorias de las resoluciones de aprobación definitiva de los instrumentos de planeamiento urbanístico

Las principales medidas introducidas por la Instrucción 1/2019 son las siguientes:

(i) Se define el contenido básico que debe reunir el informe previo que debe ser emitido por la Consejería para la aprobación definitiva de los instrumentos de planeamiento.

(ii) En los casos en los que la aprobación definitiva del instrumento de planeamiento corresponda a la Comisión Territorial de Ordenación del Territorio y Urbanismo de la Junta de Andalucía, se establece la obligación de designar a un ponente adscrito a la Delegación Territorial, al que corresponderá exponer un resumen de las principales características del instrumento de planeamiento que se someta a aprobación definitiva.

(iii) Se prevé la creación de una mesa de trabajo de carácter técnico-jurídico, integrada por personal tanto del Ayuntamiento como de la Consejería, y que tendrá por objeto impulsar el cumplimiento del instrumento de planeamiento una vez haya sido aprobado.

2. La Instrucción 2/2019, de 22 de marzo, sobre el expediente completo en el procedimiento de aprobación definitiva de los instrumentos de planeamiento general

Las novedades más destacadas introducidas por la Instrucción 2/2019 son las siguientes:

(i) Se detalla la documentación que deberán presentar los ayuntamientos ante la Consejería para la aprobación definitiva de sus instrumentos de planeamiento general.

(ii) Se establece un plazo máximo de diez días para que la Consejería compruebe que los ayuntamientos han aportado toda la documentación necesaria para la aprobación definitiva de sus instrumentos de planeamiento general y, según el caso, (a) comunique que el expediente se encuentra completo; o (b) requiera al ayuntamiento correspondiente para que completen el expediente.

(iii) En relación con el punto anterior y para el caso en el que, tras el requerimiento de la Consejería, la documentación aportada por los ayuntamientos siga siendo insuficiente, se establece un segundo plazo adicional de diez días para que la Consejería solicite nuevamente a dichos ayuntamientos la documentación que permita completar el expediente.

(iv) Por último, una vez completo el expediente, se fija un plazo de diez días en el que la Consejería deberá comunicar a los ayuntamientos que el expediente se encuentra completo, iniciándose en ese momento el plazo para resolver sobre la aprobación definitiva de los instrumentos de planeamiento general, el cual no podrá exceder de cinco meses, de conformidad con lo previsto por el artículo 32.4 de la vigente Ley 7/2002, de 17 de diciembre, de Ordenación Urbanística de Andalucía ("LOUA").

Por todo lo anterior, y sin perjuicio de eventuales consideraciones formales respecto de la posible modificación de la LOUA, resulta evidente que estas instrucciones ponen de manifiesto la voluntad de promover y agilizar la actualización del planeamiento urbanístico de los municipios andaluces por parte de la Junta de Andalucía, tratando de ofrecer una mayor claridad y seguridad jurídica en el ámbito urbanístico.
