Spain: La incidencia de las actuaciones de transformación urbanística en la categorización del suelo urbano

Sentencia, de 30 de octubre de 2018, del Tribunal Supremo, dictada en el recurso de casación 6090/2017

Resulta de especial interés destacar el contenido de la Sentencia, de 30 de octubre de 2018, del Tribunal Supremo (la "STS 30/10/18"), por cuanto se pronuncia sobre los requisitos a tener en cuenta para el cambio de categoría de un suelo urbano consolidado (entiéndase de forma general como aquel terreno que ostenta la condición de solar y se encuentra integrado en la malla urbana de la ciudad) a suelo urbano no consolidado.

En particular, la STS 30/10/18 se centra en la regulación urbanística de la Unidad de Ejecución SUNC R G-15 "Veracruz Este" de Málaga, por cuanto sus terrenos fueron categorizados como no consolidados en la RevisiónAdaptación del Plan General de Ordenación Urbana de Málaga del año 2011 (la "Revisión"), lo que supuso la modificación de la categoría que tenían previamente esos terrenos como suelos urbanos consolidados.

Dicha Revisión fue recurrida y declarada nula mediante Sentencia, de 30 de junio de 2017, de la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de Andalucía (con sede en Málaga), lo que motivó la presentación del Recurso de Casación 6090/2017 del que dimana la STS 30/10/18.

Así pues, la STS 30/10/18 ha dejado sin efecto la sentencia de primera instancia, declarando conforme a derecho la normativa urbanística recurrida y aportando, entre otros, los siguientes motivos habilitantes para el cambio de categoría de un suelo urbano consolidado a no consolidado

  • Conforme a la legislación urbanística, ha de adaptarse la jurisprudencia anterior del Tribunal Supremo declarando que un nuevo planeamiento, que contempla una determinada transformación urbanística de renovación, regeneración o rehabilitación, puede degradar el suelo urbano consolidado a suelo urbano no consolidado, siempre que concurran determinados requisitos [véase el Fundamento Jurídico nº 14 de dicha Sentencia para mayor detalle].
  • La legislación urbanística ya no tiene únicamente como finalidad esencial la formación de nuevos tejidos urbanos sobre la base de una progresiva expansión de la ciudad. Por el contrario, el Texto Refundido de Suelo y Rehabilitación Urbana contempla expresamente entre sus objetivos, respaldados por el interés general, las actuaciones de transformación urbanísticas, que pueden afectar a todo tipo de categorías de suelo, ya sean (i) actuaciones "clásicas" de nueva urbanización como (ii) actuaciones para la regeneración de la urbanización de un ámbito de suelo urbanizado y/o (iii) actuaciones de dotación para incrementar las dotaciones públicas de un suelo urbanizado con el objetivo de reajustar su proporción con la mayor edificabilidad o densidad o con los nuevos usos asignados en la ordenación urbanística a una o más parcelas del ámbito y que no requieran la reforma o renovación de la urbanización de éste.
  • En este caso, en la Revisión se justificaba ampliamente los motivos que amparaban la modificación de suelo urbano consolidado a no consolidado de los terrenos que conforman la Unidad de Ejecución del SUNC R G-15, precisando que dicho ámbito requería de una actuación de transformación urbanística que sirviese para completar la urbanización inacabada y la falta de servicios e infraestructuras.

Por lo tanto, del contenido de la referida STS 30/10/18, se puede extraer la conclusión de que lo determinante a partir de ahora para concluir sobre los derechos y deberes de los propietarios no será tanto la clasificación del suelo, sino el tipo de actuación de transformación que se pretende llevar a cabo sobre el mismo, debiendo tener en cuenta la posibilidad que otorga la legislación urbanística de actuar en suelos urbanos consolidados para tratar de lograr la regeneración de la ciudad, en muchas ocasiones erosionada por el paso del tiempo y/o la falta de terminación de proyectos, y en definitiva núcleos urbanos más sostenibles y adaptados a las actuales necesidades de los ciudadanos.
