Spain: Castilla-la mancha modifica los reglamentos de desarrollo de la ley de ordenación del territorio y de la actividad urbanística

El pasado 20 de noviembre se aprobó el Decreto 86/2018, de medidas para facilitar la actividad urbanística de la ciudadanía y los pequeños municipios de la Comunidad Autónoma de Castilla-La Mancha (el "Decreto 86/2018"), por el que se modifican los cinco reglamentos de desarrollo del Texto Refundido de la Ley de Ordenación del Territorio y de la Actividad Urbanística, aprobado por Decreto Legislativo 1/2010, de 18 de mayo (la "LOTAU").

En particular, el Decreto 86/2018 tiene el doble objetivo de:

(i) Adaptar la normativa urbanística de desarrollo a las sucesivas modificaciones legislativas que han tenido lugar desde la aprobación de la LOTAU (e.g. la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público, la Ley 13/2015, de 24 de junio de Reforma de la Ley Hipotecaria y del texto refundido de la Ley de Catastro Inmobiliario); y

(ii) Facilitar la actividad urbanística de los municipios de menor tamaño (aquellos con menos de 10.000 habitantes) y la participación ciudadana en la toma de decisiones en esta materia.

Así, cabe destacar las siguientes modificaciones que el Decreto 86/2018 introduce de manera transversal en los cinco reglamentos de desarrollo de la LOTAU:

(i) Reglamento de Planeamiento (Decreto 248/2004, de 14 de septiembre).

Como principal novedad, el Decreto 86/2018 amplía el concepto de "zonas verdes" –incluyendo las áreas saludables de ejercicios, los bulevares y parques lineales y pantallas verdes en ámbitos de uso industrial– y flexibiliza para los municipios de menor tamaño las exigencias de reservas dotacionales.

Asimismo, con esta modificación se permite que, con carácter general, en los municipios que no dispongan de ningún instrumento de planeamiento urbanístico se puedan realizar obras de nueva planta en los solares integrados en la malla urbana, así como realizar operaciones de reforma interior en los cascos urbanos.

(ii) Reglamento de la Actividad de Ejecución (Decreto 29/2011, de 19 de abril).

El Decreto 86/2018 realiza una remisión normativa a la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público para determinar un plazo máximo para la resolución de los procedimientos de adjudicación de Programas de Actuación Urbanizadora, donde se establece que estos procedimientos deben resolverse en el plazo máximo de 8 meses.

Por otro lado, introduce de forma innovadora la figura de la "reversión de la reparcelación", por medio de la cual en los supuestos en los que la ejecución de las obras de urbanización haya quedado impedida, las fincas de origen sustituirán a las fincas de resultado, dejando así sin efecto el proceso reparcelatorio previamente aprobado.

(iii) Reglamento de Disciplina Urbanística (Decreto 34/2011, de 26 de abril).

A este respecto, las principales novedades introducidas afectan a la documentación necesaria para solicitar licencias de obras y de segregación y parcelación, de tal manera que este Reglamento se adecúa a lo dispuesto en la Ley 13/2015, de 24 de junio de Reforma de la Ley Hipotecaria y del texto refundido de la Ley de Catastro Inmobiliario en aras a una mejor coordinación catastro-urbanismo.

(iv) Reglamento de Suelo Rústico (Decreto 242/2004, de 27 de julio).

En relación con el estatuto del suelo rústico, las principales novedades introducidas por el Decreto 86/2018 van encaminadas a ofrecer una mejor definición del concepto de "riesgo de formación de núcleo de población", así como a actualizar el régimen de protección de suelo no urbanizable de especial protección por la incidencia de normativa sectorial (e.g. vías pecuarias, cauces fluviales, etc.).

(v) Decreto de regulación de competencias y de fomento de la transparencia en la actividad urbanística (Decreto 235/2010, de 30 de noviembre).

Por último, cabe destacar que el Decreto 86/2018 introduce diversas modificaciones en la composición y régimen de atribuciones de las Comisiones Ordenación del Territorio y Urbanismo con el fin de optimizar y agilizar su funcionamiento, eficacia y eficiencia.

Por todo ello, teniendo en cuenta el amplio alcance de las modificaciones introducidas por el Decreto 86/2016 y su afectación a todas las facetas del ámbito urbanístico, la aplicación práctica del mismo y la casuística que de ello derive serán de especial interés tanto para las administraciones públicas como para los operadores económicos y los particulares con intereses en el ámbito de Castilla-La Mancha.
