Wetswijzigingen Arbeidsomstandighedenwet in Nederland

Op 1 juli 2017 is de gewijzigde Arbeidsomstandighedenwet (ook wel 'Arbowet' genoemd) in werking getreden. In de nieuwe wet worden werknemers en werkgevers sterker betrokken bij het arbobeleid en komt er meer aandacht voor preventie. Wat betekenen deze veranderingen voor u? In deze nieuwsbrief brengen we u op de hoogte van de wijzigingen.

Introductie basiscontract

Op dit moment zijn er grote verschillen onder de contracten tussen arbodienstverleners, bedrijfsartsen en werkgevers. De contracten zijn vaak onvolledig of bevatten te weinig voorzieningen, waardoor de arbozorg ontoereikend is. Ook is gebleken dat de bedrijfsarts vaak als onvoldoende onafhankelijk wordt gezien. Daarom worden in de Arbeidsomstandighedenwet minimumeisen gesteld aan het contract tussen arbodienstverleners en werkgevers. Deze vereisten worden vastgelegd in het zogenaamde basiscontract. Daarin moet staan hoe de arbodienstverleners de voor de werkgever verplichte wettelijke taken uitvoeren. Het contract heeft daarom enerzijds betrekking op al bestaande wettelijke taken waarbij de werkgever zich moet laten bijstaan door een arbodienstverlener of bedrijfsarts – zoals het toetsen van de risico-inventarisatie en –evaluatie – en anderzijds op de nieuwe wettelijke taak van het bieden van doeltreffende toegang tot de bedrijfsarts voor de werknemer.

Voor lopende contracten met arbodienstverleners geldt vanaf het ingaan van de wetswijziging een overgangsperiode van een jaar (tot 1 juli 2018), zodat er voldoende tijd is om de daarin gemaakte afspraken aan te passen aan de nieuwe wetgeving.

Vereisten basiscontract

In de vernieuwde Arbowet zijn rechten en verplichtingen opgenomen die bijdragen aan een goede beroepsuitoefening van de bedrijfsarts en meer aandacht besteden aan preventie in bedrijven. In het basiscontract moet daarom expliciet aandacht worden besteed aan zeven rechten en verplichtingen:

  1. Toegang tot de bedrijfsarts: de werknemer moet doeltreffende toegang hebben tot de bedrijfsarts. In het basiscontract moet worden afgesproken hoe deze toegang is geregeld, bijvoorbeeld door middel van een spreekuur;
  2. Bezoek van de werkplek: de bedrijfsarts heeft de mogelijkheid om iedere werkplek te bezoeken;
  3. Second opinion: de werknemer heeft de mogelijkheid om een second opinion aan te vragen bij een andere bedrijfsarts als hij twijfelt over het gegeven advies. De kosten voor de second opinion zijn voor rekening van de werkgever. Uitvoering van de second opinion gebeurt binnen de procedure zoals de werkgever dit afspreekt met de arbodienstverlener;
  4. Klachtenprocedure: iedere bedrijfsarts en arbodienstverlener dient een duidelijke procedure te hebben die beschrijft hoe werknemers klachten over de dienstverlening kunnen indienen. Met het oog op een goede dienstverlening dienen arbodienstverleners en bedrijfsartsen al duidelijkheid te geven over hun klachtenprocedure bij het aangaan van het contract;
  5. Overleg: het basiscontract moet omschrijven hoe het overlegd van de bedrijfsarts met de preventiemedewerker en de OR is geregeld, zodat de bedrijfsarts meer mogelijkheden krijgt om betrokken te raken bij het bedrijfsbeleid voor gezond en veilig werken;
  6. Melden beroepsziekten: het basiscontract moet duidelijk maken hoe de bedrijfsarts beroepsziekten kan opsporen, onderkennen, diagnosticeren en melden van beroepsziekten aan het Nederlands Centrum voor Beroepsziekten;
  7. Advisering over preventie: in het contract moet aandacht worden besteed aan de advisering van de bedrijfsarts aan de werkgever over preventie.

Invoering instemmingsrecht OR ten aanzien van persoon en positionering preventiemedewerker

In het wetsvoorstel is veel aandacht voor preventie. Daarom krijgt de OR – naast het takenpakket van de preventiemedewerker – ook instemmingsrecht over de persoon van de preventiemedewerker en diens positionering in de organisatie. De instemming houdt in dat de preventiemedewerker draagvlak heeft in de onderneming en dat de OR medeverantwoordelijkheid draagt voor het goed functioneren van de preventiemedewerker in de onderneming.


Het is van belang in te spelen op de nieuwe Arbowetgeving door na te denken hoe werknemers werkzaam binnen een onderneming een doeltreffende toegang tot de bedrijfsarts kunnen hebben. Ook de komst van het basiscontract brengt veranderingen met zich.

You may print and keep a copy of these Terms, which form the entire agreement between you and Mondaq and supersede any other communications or advertising in respect of the Service and/or the Website.

No delay in exercising or non-exercise by you and/or Mondaq of any of its rights under or in connection with these Terms shall operate as a waiver or release of each of your or Mondaq’s right. Rather, any such waiver or release must be specifically granted in writing signed by the party granting it.

If any part of these Terms is held unenforceable, that part shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties, and the Terms shall continue in full force and effect.

Mondaq shall not incur any liability to you on account of any loss or damage resulting from any delay or failure to perform all or any part of these Terms if such delay or failure is caused, in whole or in part, by events, occurrences, or causes beyond the control of Mondaq. Such events, occurrences or causes will include, without limitation, acts of God, strikes, lockouts, server and network failure, riots, acts of war, earthquakes, fire and explosions.
