The National Public Services Authority (ASEP) has restated to all cellular operators that must eliminate unwanted commercial and promotional text messages received by Panama users, as this could violate the right to privacy. All information needed in Resolution AN No. 3887-Telco of October 11, 2010.

This right protects both users, pre-paid and post-paid contracts, who may request by written, telephone or in person to telephone companies to update their databases in such way that it appears that they do not wish to receive commercial messages any more, and the telephone company has the obligation to make this action effective within 8 hours, at no cost.

In addition, the standard establishes a viable schedule between 8:00 a.m. and 8:00 p.m. for Mobile Operators to send promotional messages to active users in the database of commercial and/or promotional broadcast message receivers. Outside this time zone, broadcasting is prohibited.
