The examination for the registration of patent agents was held in Kuala Lumpur from 1st to 4th September 1998. This is the second time that the examination has been held, following an amendment of the Patents Regulations in 1995 that introduced the requirement for an examination.

There are four papers in all, covering technology, Malaysian patent law and practice, Malaysian trade mark and designs law and practice, and foreign industrial property law and practice. Candidates must pass all four papers before they can be entered in the Register of Patent Agents.

Other requirements for entry on the Register are domicile or permanent residence in Malaysia, and either qualification as a Malaysian solicitor or advocate or the holding of a recognized degree in a science or engineering discipline. Alternatively, qualifications entitling the applicant to graduate membership of a recognized professional engineering or scientific or institution will be accepted by the Board of Examiners.

Companies and individuals not having domicile or residence in Malaysia can only be represented before the Patent Registration Office through a Registered Patent Agent. Registered Patent agents are also entitled to be entered on the newly-introduced register of Trade Mark Agents.
