The Kentucky assumed name statute1 was significantly revised in 2006 with the objectives of: (a) ordering and rationalizing the "real names";

  1. clarifying the county where the certificate of assumed name is to be filed;
  2. clarifying the amendment and survival of certificates of assumed name; and
  3. clarifying the effect of an assumed name filing.2

Since then there have been a number of revisions to account for new organizational forms and to account for the adoption of the Kentucky Business Entity Filing Act. For that reason, a new and expanded review of the statute is in order.
