FINRA is  adding a new Problem Code, amending Rule 4530 ("Reporting Requirements") and adding new fields to the Filing Application Form. The changes will permit firms to report written complaints that firms may receive from customers regarding compliance with the new Department of Labor ("DOL")  fiduciary rule. Aspects of the DOL fiduciary rule will become effective on June 9, 2017.

The changes to the Rule 4530 Filing Application will also harmonize the form with recent MSRB rule changes related to expanded customer complaint and recordkeeping requirements on MSRB-regulated entities. FINRA is also adding a new Problem Code 15 (Municipal Advisor Conflict of Interest) and expanding the scope of several other Problem Codes to address municipal advisory-related activities. These changes will become effective on October 1, 2017.
