Comment Deadlines

  • July 18: SEC request for comments on a proposed national market system ("CAT") plan that would create a single, comprehensive database of all trading activity in the U.S. equity and options markets.
  • July 18: The CFTC proposal to require that interest rate swaps denominated in certain currencies or having certain termination dates, as described herein, be submitted for clearing by persons required to do so under the pertinent section of the CEA to a derivatives clearing organization that is registered under the CEA or a DCO that has been exempted from registration under the CEA.
  • July 19: Federal Financial Institutions Examination Council proposal to (i) establish the annual appraisal management company registry fee, and (ii) interpret the phrase "working for or contracting with" in accordance with the Dodd-Frank Act Section 1109.
  • July 20: FINRA and the Investors' Exchange LLC plan for the allocation of regulatory responsibilities.
  • July 21: SEC concept release intended to assess (i) whether business and financial disclosure requirements in Regulation S-K continue to provide the information necessary for investors to make informed voting and investment decisions, and (ii) whether any of the rules have become outdated or unnecessary.
  • July 22: The Office of the Comptroller of the Currency, the Board of Governors of the Federal Reserve System, the FDIC, the Federal Housing Finance Agency, the National Credit Union Administration and the SEC's joint proposal that would limit incentive-based compensation arrangements at covered institutions, as required by Section 956 of the Dodd-Frank Act.
  • July 25: FHFA proposal to amend its rules to make conforming changes and corrections intended to fix citations, provide for consistent use of terminology and remove outdated or duplicative rule provisions and definitions.
  • July 26: FINRA proposal to extend the implementation of FINRA Rule 4240.

Effective Dates

  • July 16: FINRA implementation of FINRA Rule 2242 (Debt Research Analysts and Debt Research Reports).
  • July 18: Amendments to MSRB's Rule G-14 to enhance trade price transparency information provided through the Real-Time Transaction Reporting System.
  • July 18: FINRA implementation of FINRA Rule 4240 – an interim pilot program with respect to margin requirements for certain transactions in credit default swaps that are security-based swaps.
  • July 18: FINRA Rule 6732 to provide FINRA staff with the authority to grant a member alternative trading system an exemption from the TRACE trade reporting obligations of Rule 6730 (Transaction Reporting) for transactions occurring on an ATS that meet specified conditions.
  • July 18: Rule change to adopt new FINRA Rule 6732 to provide FINRA with authority to exempt certain transactions executed by a member alternative trading system that meet specified criteria from the transaction reporting obligations under FINRA Rule 6730.
  • July 25: FERC is denying requests for rehearing and granting, in part, clarification of its determinations in Order No. 816, which amended its regulations that govern market-based rate authorizations for wholesale sales of electric energy, capacity and ancillary services by public utilities pursuant to the Federal Power Act.
  • July 27: CFTC final regulations relating to swap data reporting in connection with cleared swaps for swap data repositories, derivatives clearing organizations, designated contract markets, swap execution facilities, swap dealers, major swap participants and swap counterparties who are neither SDs nor MSPs.
  • July 27: FDIC final rule that implements Section 210(a)(16)(D) of the Dodd-Frank Act.
  • July 27: NCUA amendments to adjust the maximum amounts of each civil monetary penalty within its jurisdiction to account for inflation.

Compliance Deadlines

  • July 18: Implementation date for the FINRA proposal to amend Rule 6730 (Transaction Reporting) to require that firms use a "No-Remuneration" indicator to identify those transactions for which a commission or mark-up/mark-down is not reflected in a TRACE trade report.
