A growing number of restaurants are looking to take tipping out of diners' hands as early as January 1 and replace it with a 20 to 30 percent surcharge to help pay for rising wages and health care costs. However, including surcharges in bills at restaurants is currently illegal in New York City.

"I get several calls a week from restaurant owners who want to add a surcharge," said Carolyn Richmond. "But I have to tell them it's not allowed."
