I will leave it to constitutional scholars to dissect
today's decision in Obergefell v. Hodges (pdf) holding that
states cannot ban same-sex marriage. But in his dissent, Justice
Scalia says:
This practice of constitutional revision by an unelected
committee of nine ... robs the People of the most
important liberty they asserted in the Declaration of Independence
and won in the Revolution of 1776: the freedom to govern
themselves.
Where was that concern when he voted to halt the Florida recount
in 2000? Let me offer Justice Scalia the same advice he gave to
people who felt that the Supreme Court overstepped its role. "Get over it." I would even
add, "Don't let it ruin your Pride Weekend."
