Jayson Williams is a former NBA all-star who now spends his time dissecting hot button topics in sports and society on his CBS podcast.  These days, Jayson leads a frank discussion with his guests from an interesting point of view built by his experiences on and off the court.  I was happy to appear "On The Rebound" with Jayson and my brother, noted criminal defense attorney and a member of Jayson's trial team, Chris Adams, earlier this week to provide commentary on the use of e-discovery in the trial of former New England Patriots Tight End  Aaaron Hernandez, and to analyze the impact of modern technological advancements on jurors.

I explained cellular phone tower data triangulation for the audience, a component of the prosecution's case against Mr. Hernandez, as basically as an analysis of four variables: (1) the known locations of three or more cell towers; (2) the compass direction of the antennas attached to those towers; (3) their approximate distances from the handset; and (4) changing signal strengths recorded by the handset.  Analogizing cell phone tower data triangulation as akin to an exercise in deconstructing pea soup, I explained the relative imprecision associated with the data and the ways that skillful defense attorneys might be able to poke holes in the prosecution's reliance upon it.  When it came to cell phone tower data triangulation, the word of the day was definitely IMPRECISION.

I also discussed the so-called "CSI Effect" and how jurors expectations of the digital forensics evidence in the Hernandez case could be shaped  by their exposure to popular TV shows and movies where crimes are routinely solved  through high tech means with relative ease. I explained how the Hernandez jury's thirst for more about the technological components of the prosecution's case — like the cell tower data triangulation evidence — may very well work to the benefit of Mr. Hernandez in raising the reasonable doubt necessary for an acquittal.
