On January 20, President Obama urged Congress in his State of the Union address to pass legislation he said is needed to combat the evolving threat of cyberattacks.
Obama introduced proposed cybersecurity protections last week, including a national notification law that would require companies to notify consumers within 30 days of a breach being discovered.
The national breach notification law is of interest to businesses because it would eliminate the current patchwork of state and local statutes governing how data breaches are handled, said Scott L. Vernick, a noted privacy attorney.
"If you keep the legislation simple and don't have tricks, it should stand, but for the fact that you have a Republican Congress and Democratic administration," Vernick said.
