Indiana Appeals Court Affirms National Retailer's Liability For Privacy Breach

On November 14, an Indiana appeals court affirmed a $1.44
million jury verdict, holding that the retailer was liable under
the respondeat superior doctrine for a HIPAA violation by an
employee. The court determined that the HIPAA violation constituted
harm inflicted while acting within the scope of employment.
