The California Supreme Court is prepared to elaborate on a state law which will require employers to provide suitable seating for all employees. This law will particularly pertain to hotel and restaurant businesses, affecting their policies regarding such employees as hostesses and prep cooks.

As providing this seating may clash with other laws, such as zoning, safety and health code issues, attorneys hope that the California Supreme Court will discern in what ways employers are expected to accommodate the law.

Keith Chrestionson, Fox Rothschild LLP labor and employment partner and litigator based in San Francisco, commented on the Supreme Court's upcoming clarification, stating: "I hope the court comes up with a reasonable standard that allows for an evaluation. ... I hope they come up with a standard that allows safety to be a consideration as one factor."
