Scott L. Vernick was quoted in the Inside Counsel article, "Planning for the Inevitable Cyber Breach." Full text can be found in the May 20, 2014, issue, but a synopsis is noted below.

While outright prevention of cyber-attacks is impossible, limiting the effects of a data breach and the reputational damage that frequently accompanies a breach is something organizations can take measures to do.

Noted privacy attorney Scott L. Vernick, a partner at Fox Rothschild and moderator of the panel "Primer to Cyber Security Incident Response Plan," at the recent 2014 SuperConference, said "looking at the 2013 statistics, 90 percent of companies reported they've been hacked."

"There are only two types of companies, those that have been hacked and those that don't know they've been hacked," said Vernick.

The first step to combatting a breach is putting together a preliminary blueprint, but Vernick noted that while tactical plans provide instructions on what to do, they can be restrictive if taken too literally.
