An attorney who missed a filing date and attempted to remedy the mistake with a misleading brief has been sanctioned by a U.S. District Judge. The judge cited 12 "misstatements and/or mischaracterizations" by the attorney in his motion to vacate dismissal of an employment suit, Nanavanti v. Cape Regional Medical Center, 12-cv-3469.
Among the misstatements was the attorney's contention that a motion to dismiss was granted on September 19, 2012, when it was in fact granted on October 23, 2012, the judge said.
Defense counsel Sarah Beth Johnson filed the motion to dismiss on September 18, 2012. William Honan was also a member of the defense's representation.
