The Equal Employment Opportunity Commission's (EEOC) policy insisting on individualized research into applicants' and workers' criminal backgrounds has created issues for employers who are trying to ensure safety for their customers and employees. The policy can be especially burdensome for large companies that are processing numerous applications. 

The process of conducting individualized background checks "raises the issue of hiring people who may cause liability, perhaps because of their criminal background," says Richard Cohen.
