On April 22, 2014, Richard B. Linderman, Esq., a partner in Herrick's Community Association Group, obtained summary judgment on behalf of a York County homeowners association against a homeowner that has refused to pay common expense assessments for over two years. The debtor homeowner has had a long standing dispute with the association regarding maintenance of the common elements and related landscaping. The debtor has refused to pay his assessment and also brought a counterclaim against the association. The Court held that payment of the common expense assessments was an automatic responsibility of the homeowner whether or not the association properly maintained the common elements. The amount of the unpaid assessments plus attorneys' fees and legal costs were awarded to the association.
