Although most people are familiar with the basic concept of global custody the legal relationship between custodian and customer is never closely considered until problems arise.

This article looks at the legal relationship between custodian and customer, the general fiduciary duties and statutory and contractual provisions of a custodian and the extent to which a custodian may be regarded as a trustee.
