"Davacının, davasından
feragat etmesi halinde uyuşmazlık sona erer ve feragat
nedeniyle davanın reddine karar verilmesi gerekir. Davacı
feragat beyanı ile bağlıdır ve bu
beyanından dönemez. Ancak, feragate ilişkin irade
açıklamasının gerçeği
yansıtmadığının bildirilmesi halinde,
iddianın ön sorun şeklinde incelenmesi, feragat
beyanının gerçek iradeyi yansıtıp
yansıtmadığının
açıklığa kavuşturulması,
gerçekten davacının hileye
düşürüldüğü saptanırsa
feragat beyanının bir hukuki netice
doğurmayacağı gözetilerek işin
esasının incelenmesi, aksi halde feragat nedeniyle
davanın reddine karar verilmesi gerektiği
gözetilmelidir."
