GAO Forum Concludes Health Care Reforms Necessary To Control Unsustainable Spending
On May 28, the United States General Accounting Office ("GAO") released a special publication containing highlights of the GAO's January 2004 Health Care Forum. Participants concluded that U.S. wealth and other factors drive up health care spending, which could induce adverse economic implications if not contained, and that the nationwide variation in use of medical services suggests that there are quality and efficiency problems in the current healthcare system.

Texas Department of Health Adopts Final Rules For Reporting of Medical Errors
In 2003, the Texas Legislature passed House Bill 1614 (H.B. 1614), which requires hospitals, ambulatory surgical centers (ASCs), and mental hospitals to document certain types of medical errors and report the number of occurrences of these types of errors annually.

CMS Extends Deadline For Section 1876 Cost Plan Service Area Expansion Applications
On March 12, 2004, the Centers for Medicare and Medicaid Services ("CMS") announced that it will accept service area expansion applications that are submitted on or before September 1, 2006 from Section 1876 cost contractors. The Medicare Prescription Drug, Improvement and Modernization Act (the "MMA"), which created the Medicare Advantage ("MA") program, amended Section 1876(h)(5) of the Social Security Act to allow CMS to extend or renew all reasonable cost contracts beyond the previous limit
