The U.S. Supreme Courtís recent decision in Arkansas Department of Health and Human Services v. Ahlborn, 164 L. Ed. 2d 459,126 S. Ct. 1752 (May 1, 2006), is not a products liability case. It is, however, a case involving a state Medicaid programís claim for recoupment of program funds expended for medical care provided to a Medicaid recipient who entered into a settlement agreement with a third-party tortfeasor alleged to be responsible for the recipientís injuries.
