La Secretaría del Trabajo y Prevención Social emitió, el 31 de julio de 2019, el Protocolo para la legitimación de contratos colectivos de trabajo existentes.

El pasado 31 de julio de 2019, la Secretaría del Trabajo y Prevención Social (la "STPS"), publicó en el Diario Oficial de la Federación, el "Protocolo para la legitimación de contratos colectivos de trabajo existentes" (el "Protocolo"), el cual forma parte de las reformas realizadas en mayo del presente año a diversos ordenamientos en materia laboral con el propósito de transparentar, legitimar y democratizar las relaciones y negociaciones colectivas de trabajo entre empresas y sindicatos.

El proceso de legitimación y "democratización" sindical consiste en someter a consulta de los trabajadores afiliados al sindicato titular del contrato colectivo, su conformidad con dicho contrato colectivo. En caso de que el contrato colectivo no cuente con la aprobación del voto personal, libre, directo y secreto de al menos la mayoría de los trabajadores, entonces el mismo se tendrá por terminado; sin embargo, subsistirán las prestaciones y condiciones de trabajo que sean superiores a las establecidas en la Ley Federal del Trabajo.

El Protocolo establece el proceso mediante el cual el sindicato titular del contrato colectivo de trabajo deberá someter el mismo a legitimación, el cual incluye las siguientes acciones, entre otras:

  • El sindicato titular del contrato colectivo dará aviso electrónico a la STPS de la realización de la consulta, con al menos 10 días hábiles de anticipación a la fecha que se prevea realizar la consulta.
  • El aviso electrónico deberá de contener cierta información general relativa al sindicato, el contrato colectivo de trabajo y el patrón; así como la fecha y horario en que se realizará la consulta, para el caso de que el sindicato opte por que ésta sea verificada por un fedatario público o por una autoridad laboral.
  • El patrón deberá otorgar las facilidades necesarias para que se realice la consulta, así como entregar a sus trabajadores un ejemplar impreso del contrato colectivo de trabajo, por lo menos tres días hábiles antes de la fecha de la consulta.
  • El sindicato deberá de utilizar los documentos (convocatoria, boletas y actas de votación) que hayan sido generados por medio de la plataforma electrónica que establezca la STPS para realizar el proceso de consulta. Estos formatos serán los únicos autorizados para el procedimiento de consulta, por lo que cualquier otra documentación utilizada se tendrá como no válida.
  • El sindicato dará aviso a la STPS a través de la plataforma electrónica del resultado de la votación dentro de los tres días hábiles siguientes a la fecha en que se realizó la consulta. En caso de no hacerlo, el contrato no se tendrá por legitimado.
  • El patrón no podrá tener intervención alguna durante el procedimiento de consulta.
  • En caso de que la STPS no realice observaciones durante los veinte días hábiles siguientes a la fecha en que el sindicato remita el aviso de resultado, el contrato colectivo de trabajo sometido a consulta se tendrá por legitimado.

Conforme al Protocolo, la STPS podrá solicitar a las Juntas de Conciliación y Arbitraje que exhorten a los sindicatos para que legitimen los contratos colectivos conforme al presente Protocolo. En caso de que no realicen el proceso de legitimación antes del 1º de mayo de 2023, el contrato colectivo se tendrá por terminado.

El nuevo Protocolo entró en vigor el 1 de agosto de 2019 y estará vigente hasta en tanto el Centro Federal de Conciliación y Registro Laboral inicie sus funciones registrales y de verificación.

No delay in exercising or non-exercise by you and/or Mondaq of any of its rights under or in connection with these Terms shall operate as a waiver or release of each of your or Mondaq’s right. If any part of these Terms is held unenforceable, that part shall be enforced to the maximum extent permissible so as to give effect to the intent of the parties, and the Terms shall continue in full force and effect.

Mondaq shall not incur any liability to you on account of any loss or damage resulting from any delay or failure to perform all or any part of these Terms if such delay or failure is caused, in whole or in part, by events, occurrences, or causes beyond the control of Mondaq. Such events, occurrences or causes will include, without limitation, acts of God, strikes, lockouts, server and network failure, riots, acts of war, earthquakes, fire and explosions.
