Federal Circuit Elaborates on Role of Hatch-Waxman Statute in Preliminary Injunction Analysis

In this November 22, 2005 decision, the Federal Circuit affirmed a New Jersey District Court's grant of a preliminary injunction enjoining defendants Teva Pharmaceuticals USA, Inc., Ranbaxy Pharmaceuticals, Inc. and Ranbaxy Laboratories Limited from infringing U.S. Patent No. 4,743,450 ("the '450 Patent"). The Federal Circuit ruled that the district court correctly found irreparable harm to the patent owner in the absence of the preliminary injunction....
