On April 25, the Privacy Commissioner for Personal Data
("PCPD") released a media statement revealing that an insurance
agent was convicted of two offenses under the Personal Data (Privacy) Ordinance for using
personal data in direct marketing without taking specified actions
and obtaining the data subject's consent, and for failing to
inform the data subject of his opt-out right when using his
personal data in direct marketing. A Community Service Order of 80
hours was imposed by the court on the convicted insurance
agent.
