UK: Mayer, Brown, Rowe & Maw LLP Confronts Business Disruption Head On
Last Updated: 24 June 2003

Mayer, Brown, Rowe & Maw LLP has set up a Business Disruption Response Team which is thought to be the first of its kind in the UK.

Business disruption can come in a number of different forms and can result in businesses being closed down. This can happen for a wide range of reasons including as a result of safety inspections and regulatory reasons. It can also result from a sustained and focussed campaign by protestors or employees.

With more and more businesses confronting disruption or receiving unwanted attention, MBR&M LLP have set up an experienced and dedicated team to advise on how these problems can be handled. There has been a steep rise in direct action over the last few years exemplified by the fuel crisis, anti-war protests and the countryside marches. With increased media attention being given to environment and consumer issues and the greater regulation of UK businesses, companies could be many times more likely to face disruption now than 10 years ago.

The Team is headed by Litigation & Dispute Resolution partner Antony Phillips and will provide businesses with advice not only on how to deal with current problems, but also how best to prepare for any possible disruptions in the future. Expertise can be drawn from the Litigation, Environment, Intellectual Property, Public Law and Employment Groups at MBR&M LLP.

Phillips is a solicitor advocate and has wide experience in advising companies on business disruption issues. Recent matters include:

  • Advising major companies on widespread picketing of distribution sites;
  • Acting in the leading protest case against field trials of genetically modified crops; and
  • Advising in respect of internet attacks against a major product manufacturer and their products.

Phillips says, "Law firms have traditionally provided this kind of advice through a general corporate or litigation team but listening to our clients, we believe there is a real need for specialist advice in this increasingly relevant area. We have the expertise to guide businesses through a disruption and also to advise on the implications of legal solutions on publicity management."
