United States: Fox Rothschild Represents Silverman’s Stationery Store In Real Estate Suit

Fox Rothschild Partner Rick Bier is representing Silverman's Stationery Store, a card and gift shop in the Livingston Town Center, NJ, against its landlord in an alleged breach of lease contract.

According to the owner of Silverman's, which has existed in the Town Center for more than 70 years, the landlord violated a section of its lease agreement that states that the landlord will not lease space in the Center to a tenant whose business directly competes with Silverman's, particularly in the areas of lottery tickets and greeting cards.

The Livingston Town Centers original redevelopment plan called for residential and boutique stores, but difficulties with parking and construction have impeded the project's ability to attract boutique Tenants. To accommodate for the unrented space, large convenience stores have now been added to the list of permissible tenants, which poses a major concern for current owners in the Center.

7-11 is among the stores being potentially added to the Center. This major chain store would threaten Silverman's profit stream, of which lottery tickets are a main source.

The landlord has refused to negotiate with Silverman's, and many in the local community are supporting Silverman's through town meetings, petitions and letters to the West Essex Tribune.
