United States: Ted Kobus Named MVP For Privacy & Consumer Protection

New York, NY, November 13, 2013 – BakerHostetler is proud to announce that partner Theodore J. Kobus III has been named an MVP by national legal publication Law360 and profiled as an "elite law firm partner" on their site. Kobus was selected for his ability to seamlessly manage high-stakes, high-profile, complex, multijurisdictional engagements and secure positive outcomes for the firm's clients. Kobus is one of only three attorneys selected nationally by Law360 in the area of Privacy & Consumer Protection. He is co-leader of the firm's national Privacy and Data Protection Team.

Kobus, who has handled more than 500 breaches during his career – including over 175 from October 2012 to October 2013 – spearheaded the launch of BakerHostetler's innovative Data Breach Hotline, an avenue for entities to receive immediate assistance when a potential data breach incident is suspected. A team of privacy lawyers, including Kobus himself, is available 24/7 to promptly guide an organization through the intricacies of a data breach response at its most crucial moment – at the time it is discovered. Kobus and his team have partnered with their clients in helping them manage some of the largest and most complicated health care and credit card data security incidents reported.

In the profile, published on November 12th, Law360 noted Kobus' pervasive work handling data breaches for healthcare organizations – citing in particular his litigation work in a potentially precedent-setting putative class action case that is one of the first attempts to apply the California Confidentiality of Medical Information Act to a data breach incident. Kobus is defending Eisenhower Medical Center from a class seeking more than $500 million in damages as a result of the theft of a computer containing limited demographic information on more than 500,000 individuals.

The Law360 article quoted a number of Kobus' clients, including Amy Stanphill, deputy general counsel for Eisenhower: "He took my panic level down 10 notches," said Stanphill. "His demeanor, knowledge and proficiency in this area of the law is really what gives me great comfort."

Law360 also quoted Kobus' client Jason Straight, senior vice president and chief privacy officer at legal services provider UnitedLex Corp, who said Kobus is a true counselor to his clients, in the traditional sense of the word. "He has a strong ability to bring calm and confidence to a very chaotic situation," Straight said. "He's able to really help them look a few moves ahead at all times and be prepared for what's coming."

Under Kobus' leadership, the BakerHostetler team has defended and counseled clients through dozens of investigations in the U.S. Department of Health and Human Services' Office for Civil Rights and Office of the Inspector General, as well as the Department of Education, Federal Trade Commission and state Attorneys General. Due to his considerable experience handling investigations, Kobus was recently asked to participate in the National Association of Attorneys General Fall Consumer Protection Conference – he was the only outside counsel speaker to present at this prestigious event open only to Attorneys General and their staff.

According to Law360's MVP announcement, the publication gathered a group of editors to review "hundreds of submissions from the top law firms in the world, ultimately settling on 138 MVPs from 26 practice areas for their exceptional work in litigation or transactions between October 2012 and October 2013."
