Guernsey: World's First Image Rights Legislation Examined At London Seminar

An insight into the capabilities of the world's first image rights legislation will be provided at a London seminar later this month.

Leading industry figures have been confirmed as panellists for the event which will explore how Guernsey's unique legislation, which came into force at the start of December, can be used to manage and protect image and brand.

Panellists for the event are Dominic Crossley of Collyer Bristow, Mark Engelman from Hardwicke and David Evans of Collas Crill IP. Elaine Gray of Carey Olsen, who will moderate the panel session, will also provide an overview of the legislation. John Ogier from the Bailiwick of Guernsey Intellectual Property Office will begin proceedings by speaking on the background leading up to the launch of the image rights register.

Topics to be covered at the event include the practicalities of implementation; the difference between an image right and other IP rights; financial management; scope and use of image rights; and how to deal with infringement, including brand and reputational issues. The event should appeal to IP, sports and entertainment lawyers, as well as agents, accountants and brand managers.

Fiona Le Poidevin, Chief Executive of Guernsey Finance - the promotional agency for the Island's finance industry, said the event would provide a valuable insight into what was a new chapter for asset protection and exploitation management.

"The seminar is an ideal opportunity to showcase Guernsey's unique image rights legislation and the benefits it can provide in terms of image protection and brand reputation. Being able to register image rights in an environment which recognises them by statute provides greater clarity in the definition of rights and a higher degree of protection from unauthorised use by third parties than is currently on offer in any other jurisdiction," she said.

"We are delighted to have secured Dominic and Mark on our panel of experts. They are leaders in their respective fields in the UK and I'm sure that along with David from Collas Crill IP's Guernsey office, the panel will deliver an informative and entertaining discussion on the value of the world's first image rights legislation. In addition, Elaine, John and David were heavily involved with the development of the Guernsey legislation so will be in a great position to answer any questions that might emerge."

The Guernsey Registry's Intellectual Property Office opened for image rights registrations on Monday 3 December and its register has been attracting significant interest from the UK and beyond since then. In fact, on the morning the register opened, a team from Carey Olsen, acting on behalf of corporate and branding specialist Lesley Everett of Walking TALL International Ltd., made the first ever application for the registration of a personality and associated image rights.

There has also been a substantial number of on-Island practitioners registering as image right agents. Indeed, more than 150 local advocates, financial service providers and intellectual property specialists have so far attended Guernsey Intellectual Property Office training courses on the new legislation and associated infrastructure.

"We have heard that there has been a lot of interest in the concept and we look forward to further registrations being made in the coming year. The hope is that in addition to using Guernsey for its unique image rights capability, global personalities and brands will use the Island's broader wealth management offering to service their wider financial needs," said Miss Le Poidevin.

The Guernsey Image Rights Event takes place from 4.30pm on Wednesday 23 January at the Corinthia Hotel, London. It will be followed by a drinks reception, sponsored by Investec, at 6pm. Intertrust is sponsoring registration and coffee which will be served from 4pm.
