Australia: Crackdown aimed at David Tweed could have unexpected consequences

Legal experts have warned that a crackdown on off-market share buyers could allow companies frustrate media efforts to access share registers.

Swaab Attorneys partner Alistair Jaque told the annual Chartered Secretaries of Australia conference on the Gold Coast that the change would tip the balance in favour of boards. Aggrieved applicants would have the right to ask a judge to rule on whether the refusal was justified, but there were concerns this would add to costs.
