United States: There’s No Place Like Home For Patent Infringement Actions

The Federal Circuit's interpretation of the venue statutes has resulted in nearly three decades of practice allowing the filing of patent infringement suits in any judicial district in which a corporate defendant is subject to personal jurisdiction. The Supreme Court's decision in TC Heartland LLC v. Kraft Foods Group Brands LLC, however, has significantly limited venue in patent infringement actions, deciding that a patent owner can only bring suit against a corporate defendant in either (1) the defendant's state of incorporation or (2) where the defendant has committed acts of infringement and has a regular and established place of business.

The panel will discuss the Supreme Court's decision in TC Heartland and factors for consideration going forward, including:

  • The Supreme Court's guidance for selecting an appropriate jurisdiction for bringing a patent infringement litigation
  • What jurisdictions are likely to see a significant increase or decrease in the number of patent infringement filings
  • The effect of the decision on the choice of state in which to incorporate or locate principal places of business
  • Evaluation of possible venue challenges in pending litigations as a result of the decision
  • How the decision may impact Hatch-Waxman pharmaceutical ANDA and biosimilar cases and cases filed by non-practicing entities
