Australia: [Event-Sydney] Unfair contracts workshop
Last Updated: 8 May 2017
Article by Mr Michael Cossetto

Has your business reviewed its standard contracts to check whether they are potentially unfair?

On 12 November 2016, the unfair contracts regime commenced applying to small business contracts. A small business includes a business generally employing less than 20 people.

To assist you with complying with the regime and ensuring that your business' interests are protected, Bartier Perry is holding an intensive half day workshop to provide you with:

  • A good understanding of the unfair contracts regime as it applies to small business contracts and whether it applies to your organisation.
  • The ability to identify terms which may potentially be unfair and in breach of the regime. We will look at real life cases to see how the Courts have applied the legislation.
  • Tips on how to modify your contract terms to ensure they are compliant. In doing so, we will review real examples of terms, provided by participants, that may be considered unfair.

Who should attend?

This workshop is ideal for:

  • Businesses that enter into contracts with small business and wish to understand whether their standard contracts are potentially unfair;
  • Franchisors and franchisees;
  • Lessors dealing with small business lessees;
  • Small businesses who frequently enter into standard contracts and wish to better understand their rights under the law;
  • Providers of financial products and services (including lenders) who deal with small business.
