A practical guide to managing contracts in turbulent times

The success of your contract and project during an economic downturn is largely determined by the decisions that are made during the procurement phase including information requested and evaluated, financial analysis of tenderers and consideration of tenderers' cash flows, work flow and general solvency. The flexibility of your contract to deal with changes in the economic climate is also a vital factor.


This seminar will consider the specific issues in contractor selection in an economic downturn and will give practical tips about how best to manage your contracts through tough economic times. In particular the seminar will consider key contractual issues that must be considered, such as:

  • Termination rights under the contract - What should they be and when should you use them?
  • Payment regimes and suspension rights - What is the impact of the payment regime on the contract and can I use this payment regime to protect the principal's interests?
  • Guarantees from banks and directors - What are they, when should they be used and what are the benefits?
  • Insuring against insolvency - Is it possible?
  • Direct payment of subcontractors - Can you do this and what are the implications?
  • Contract administration and communication with contractors - Why is this important and how will it assist to ensure that the project reaches completion?
