Property transactions are on the ATO's list of favourite GST audit targets. The area continues to produce disputes, as property covers the full range of GST treatment – taxable, input taxed, GST-free and out of scope supplies.

In this webinar, partner Fletch Heinemann will work through case studies that draw out the GST traps that lie in property transactions – and the solutions to navigate around them.

We will work through the following issues:

  • Is your client's property residential premises, commercial residential premises, commercial premises – or none of the above?
  • What happens when the sale of a property has a mixed GST treatment – and how do you manage the risk?
  • What is the correct GST treatment when only part of the property is actively used in an enterprise?
  • Given forecasts for the market to slow, what happens if your developer client decides to lease the property – how do they have a dual purpose and what is its effect on new residential premises and the 5 year rule?
  • Adjustments to watch out for – when will Divisions 129, 135 and 138 apply?
  • What are the risk issues for clients buying serviced apartments after the High Court decision in MBI Properties?

This webinar will be the precursor for a subsequent webinar to be scheduled for early 2017 focusing on the GST margin scheme – Fletch's favourite topic!
