Tax and estate planning lawyer, Joan Jung, will be ​moderating the session on Post Mortem Planning – Private Corporation Shares at the Osgoode Hall, Donald Lamont Learning Centre. The panel includes Michael Atlas, CPA, CA, TEP of Michael Atlas Chartered Accountant and Brian Nichols, JD, TEP of Speigel Nichols Fox LLP.

Summary: Post mortem planning involving private corporation shares is complex and ever developing. Our speakers, Brian Nichols and Michael Atlas are two of the authors of the "golden oldie" series of articles titled "Estate Planning in the 21st Century" which may have jumpstarted pipeline concepts for many planners. They will provide an overview of post mortem planning choices where the deceased owned private corporation shares and the decision process to manage overall tax liability. Then they will delve into a selection of issues including non-resident beneficiaries (such as withholding tax implications and streaming of distributions in ways to optimize tax results); and discuss testamentary spouse trust problems and pipeline developments.
