Many employers misunderstand the distinction between an employee and a contractor and assume that a worker must be one or the other for all purposes. If only it were that simple..... Often, there can be different answers to the employee vs contractor question:

  • Are you asking this question for the purposes of superannuation, workers' compensation or leave benefits?
  • What are the other risks of engaging this type of worker?
  • What about safety? Who's responsible for that?
  • Can I stop a contractor from poaching my customers or staff?
  • What protections can I put in place?
