New York Partner Janet Broeckel successfully represents the defendant/appellant against a claim for additional attorney’s fees when the plaintiff has previously accepted a settlement covering all rights to attorney’s fees. Plaintiff had accepted a Rule 68 Offer of Judgment on various claims. Therefore, the court found that no additional award of attorneys’ fees was appropriate when the state law claim involved substantially identical facts as the case which had been before the U.S. District Court, and that the legal work on them was essentially indivisible.
