British Virgin Islands: Harneys Approved As BVI Registered Trade Mark Agent

Harneys is now one of a small group approved to act as a registered trademark agent by the BVI Financial Services Commission.

On 1 September 2015, the Trade Marks Act 2013 was brought into force with one of the new requirements being that only registered trade mark agents may make applications to register marks in the Territory.This was a big step away from the process under the previous legislation which allowed anyone to file applications.

The new legislation imposed a rigorous vetting process under which applicants needed to demonstrate a depth of knowledge of intellectual property law and general professional competence.

Harneys Partner Jacqueline Daley, who heads the BVI trade marks practice, commented "The approval reflects Harneys expertise in this area and allows us not only to continue to register trade marks on behalf of our diverse client base but also to assist with registrations for clients of the numerous entities who have not yet been granted approval."
