This week sees reports of another year in which the use of mediation has increased. Sean McTernan published three articles with Mondaq in 2003 looking at the relevance of ADR to the media, underpinned by the broad message that it is not wise to ignore the phenomenon.

It is generally recognised that along with legal and commercial aspects, mediation, in particular, is a very human process where psychological aspects present themselves in all areas and are worthy of further consideration.  This was underlined by recent four-day course in London focusing on maritime law, mediation and psychology.

This course is prompted by a successful seminar last year for lawyers and media executives which raised a number of issues about perception in the media industry of mediation and likely future use.

The course is lead by Sean McTernan, solicitor and mediator, together with Dr. T. O'Brien, a psychologist with expertise in dispute resolution. This extends from football's Premier league (where he is team psychologist to a premiership club) to advising nationally those who must confront challenging behaviour and deal with disputes. He has lectured and published extensively on topics relating to mediation.

The six hours of CPD comprise briefings on relevant media law and psychological models illustrated by role-playing mediation situations and engaging in analytical exercises. It is graded as an intermediate course, but designed to allow access for lawyers, mediators and television executives.
