Recent changes to the tax treatment of employee shares schemes (ESS) mean that many companies can now offer very tax effective incentives to their employees.

In this discussion forum we will discuss the new opportunities available, as well as the tax, commercial and other practical issues with implementing an ESS, including:

  • what companies will qualify as a 'start up'
  • the new rules for start-ups and how clients can take advantage of them
  • the changes to existing rules for non start-up companies
  • dealing with the Corporations Act requirements
  • practical provisions that should be included in the rules governing the ESS
  • the employment law implications of granting rights under an ESS
  • whether employees should be given a direct share interest in the company or an indirect interest (e.g. via a share trust)
  • other pros and cons with common structuring options.
