Matrimonial and de facto disputes are becoming increasingly complex, touching on not only family law issues but also those relating to revenue, structuring and commercial considerations. In this seminar, two of our partners will discuss common family law, commercial and tax issues using a case study.

Justine Woods, the leader of our family law team, will cover:

  • basic family law principles regarding property settlements
  • the uses of financial agreements
  • recent trends in the approach to structures and related entities.

Scott Hay-Bartlem, the leader of our commercial team, will then discuss:

  • commercial issues in dividing up business and investment structures, particularly removing ex-spouses from family trusts
  • common duty traps to look out for
  • tax issues such as Division 7A, family trust election, trading stock and CGT rollovers.
