All businesses should be conscious of managing the risks inherent in commercial interactions that may (or may not) lead to legal commitments. Striking the balance between just letting the company 'get on with business' and implementing processes and behaviours that mitigate risk can be more art than science.

We will seek to explore this balance further by discussing:

  • the basics of exposure associated with negotiations and tenders
  • managing information flow and controlling its effect
  • identifying the risk 'moments of truth'
  • designing a process for commitment (including for tenders and sole negotiations)
  • letters of intent, MOUs, and similar arrangements.
